By placing an order, the buyer acknowledges the following conditions as binding for both parties.
A contract is concluded upon placing an order.
1. Pricing:
All prices include statutory VAT and exclude shipping costs. Prices are always subject to change. The prices valid on the day of delivery apply.
2. Shipping costs
The following flat rates apply for packaging and shipping: Germany 5.90 Euro / EU 8.90 Euro / World 16.90 Euro.
Deliveries are made by parcel service.
Additional costs are incurred for cash on delivery shipments.
If not all items can be delivered immediately and the customer requests a partial delivery, shipping costs will only be incurred once for the customer.
Partial deliveries are only carried out at the customer's written request.
3. Product returns
Product returns that do not concern the Distance Selling Act can generally only be accepted after prior arrangement. A full credit of the goods' value will only be issued if the goods are sent to us in their original packaging. In other cases, we reserve the right to charge for incurred costs.
4. Right of withdrawal
Consumers within the meaning of § 13 BGB, i.e. persons who purchase goods for a purpose that cannot be attributed to either their commercial or independent professional activity, have a right of withdrawal under § 361 a BGB. The withdrawal period begins at the time the customer has been provided with clearly designed information about their right of withdrawal, which clearly explains their rights in accordance with the requirements of the communication medium used, on a durable data carrier. The withdrawal period is two weeks. The withdrawal does not require any justification. To comply with the deadline, it is sufficient to send the withdrawal in good time to the address given above at JB Vertrieb Mosadal. The return of goods must be made to this address. There is no right of withdrawal for contracts for the delivery of goods that are manufactured according to customer specifications.
5. Rectification - Warranty
During the warranty period of 24 months after delivery, there is initially a right to free rectification. If necessary, the goods will be exchanged at the expense of J.B Vertrieb Mosadal. The right to cancellation and reduction is initially excluded. However, if the defect is not remedied within a reasonable time, the customer has the right, at their discretion, to cancel the purchase contract (cancellation) or to reduce the purchase price (reduction). When returning, the original packaging must be used, and for technical devices, the warranty and service documents must be enclosed.
6. Payment terms
The invoice is due for payment net without deductions 30 days after the invoice date. The goods remain the property of the supplier until full payment.
7. Security
Personal data important to us will be stored - as far as permitted by the Federal Data Protection Act. All information provided by the customer will only be used for internal purposes and will not be passed on to third parties. Email addresses will neither be passed on nor used for advertising purposes, unless the customer expressly requests it.
8. Delivery time
Delivery will be made within 3 working days, unless otherwise specified.
9. Terms and Conditions
Otherwise, the statutory provisions apply.
10. Place of performance and jurisdiction
The place of performance and jurisdiction for the mutual obligations arising from the contractual relationship is Berg, Germany.
